Ben M. Gushue

Ben first moved south to attend college at the University of Virginia, graduating with majors in Government and Philosophy (and an unofficial minor in bartending). After graduation, he spent several years in Charlottesville’s hospitality industry, where he found that many small business owners and coworkers struggled to access legal help, an experience that inspired him to attend law school with the goal of returning to Charlottesville to serve the community.  Ben went on to earn his Juris Doctor from Washington and Lee University, where he served as a student attorney at the Community Legal Practice Center (CLPC), representing indigent local clients on matters ranging from personal property disputes to administrative appeals, estates, and criminal defense. The CLPC gave him many hands-on lessons in Virginia practice, leaving him hungry for more; that early exposure led him to the trial lawyers at MichieHamlett.

Ben’s practice now encompasses a variety of areas, including motor vehicle and trucking crashes, medical malpractice, premises liability, products liability, and sexual assault. He has helped clients recover numerous six and seven figure settlements, navigating complex legal issues such as sovereign immunity, employer liability, and Virginia’s medical malpractice cap. Ben is committed to holding negligent parties accountable and securing full and fair compensation for the injured. He has also served on multiple trial teams that achieved large recoveries for the plaintiff, including in March 2025, when the MichieHamlett team secured a $3,000,000 verdict in Lynchburg, Virginia, the second largest verdict in that jurisdiction’s history.

Beyond litigation and trial practice, Ben is a proud member of the American Association for Justice, the Virginia Trial Lawyers Association (VTLA), and the Charlottesville Albemarle Bar Association. Ben currently serves on the Executive Board of VTLA’s Young Trial Lawyers Section.
